1. Statutory Legal Framework: MoLVT Prakas 443/18
In 2018, the Cambodian Ministry of Labour and Vocational Training (MoLVT) issued Prakas No. 443/18, formally reforming the Labour Law framework surrounding severance and seniority payments. Under these regulations, the former end-of-service indemnity was replaced with ongoing semiannual Seniority Indemnity (ប្រាក់បំណាច់អតីតភាពការងារ).
This statutory mandate applies to all enterprises and establishments covered under Article 1 of the Cambodian Labour Law, including retail stores, hospitality groups, corporate offices, technology firms, and manufacturing facilities across Phnom Penh and all provinces.
Annual Seniority Indemnity = 15 Days of Actual Wages & Fringe Benefits
• June Payment (First Semester): 7.5 Days
• December Payment (Second Semester): 7.5 Days
Executive Compliance Note: For enterprises operating in Cambodia, failure to disburse biannual seniority pay in June and December constitutes a serious labor violation subject to MoLVT inspection fines. 2. Eligibility Requirements & Service Thresholds
The law distinguishes between employees who serve a full 6-month semester and those who join mid-cycle:
| Continuous Service Duration | Semester Entitlement | Payment Timing |
|---|---|---|
| Less than 1 month | 0 Days | N/A |
| 1 to 6 continuous months | 7.5 Days (Full Semester) | End of June / December |
| Full 6 months in semester | 7.5 Days (Full Semester) | End of June / December |
| Full Year (12 months) | 15.0 Days (Annual Total) | Split in 2 installments |
Important Compliance Rule: If an employee joins on May 1st and completes 2 continuous months of service before June 30th, they are legally entitled to the full 7.5 days of seniority pay for that semester. They are not prorated down to 2.5 days.
3. The Official MoLVT Calculation Formula
The basis of calculation is the employee's actual average wages and allowances earned during the 6 months preceding the payment, divided by the standard working days in a month:
$$\text{Daily Base Wage} = \frac{\sum (\text{Gross Wages} + \text{Fixed Allowances} + \text{Overtime})}{\text{Number of Working Days in Period}}$$
$$\text{Seniority Payment} = \text{Daily Base Wage} \times 7.5 \text{ Days}$$
Practical Numerical Example:
Consider an operations supervisor at a Phnom Penh retail store with the following earnings between January and June:
- Base Monthly Salary: $650.00
- Monthly Fixed Attendance Allowance: $30.00
- Average Overtime per Month: $70.00
- Average Monthly Gross Earnings: $750.00
- Contractual Days per Month: 26 Days
Average Daily Earnings = $750.00 / 26 Days = $28.846 / Day
First Semester Seniority Pay (7.5 Days) = $28.846 × 7.5 = $216.35 USD
In Khmer Riel (at NBC rate 4,100 KHR) = ៛887,035 KHR
4. UDC vs. FDC: The Critical Contract Distinction
A frequent compliance error made by foreign and local employers is confusing UDC and FDC rules. Understanding contract classifications is essential (read our detailed FDC vs UDC Employment Contracts Guide):
| Attribute | Undetermined Duration Contract (UDC) | Fixed Duration Contract (FDC) |
|---|---|---|
| Seniority Indemnity | Mandatory (15 days / year) | Not Applicable |
| Disbursal Frequency | June & December | End of contract term |
| Expiration Indemnity | N/A (continuous employment) | Mandatory 5% Severance Pay (Article 73) |
| Prior Notice for Dismissal | 7 days to 3 months based on seniority | Same as contractual end date |
| Max Cumulative Duration | Indefinite until lawful termination | Max 2 years cumulative |
5. Tax on Salary Exemption Rules
Under General Department of Taxation (GDT) Circulars, statutory seniority indemnity paid to Cambodian resident employees is exempt from Tax on Salary (ToS) provided it does not exceed the statutory 15 days of base wages and mandatory allowances.
Any discretionary or voluntary bonus paid above the statutory 7.5 days per semester is fully taxable at regular progressive rates (0% to 20%). For complete bracket breakdowns and dependent deductions, consult our Cambodia Tax on Salary Handbook.
